A CBI court in Ahmedabad on Tuesday sentenced former Debt Recovery Tribunal (DRT) inspector Anil Kumar Sharma and advocate Amit Kotak to two years’ rigorous imprisonment, and imposed a total fine of Rs 1.5 lakh on them in a 2009 bribery case.
The two were booked on January 15, 2009, following allegations that Sharma, then a recovery inspector, and Kotak, a DRT lawyer, had demanded illegal gratification of Rs 3.5 lakh from the complainant. The bribe was allegedly sought to settle an auction-related issue involving three properties and to defer the execution of an already auctioned property belonging to the complainant’s cousin.
According to a CBI statement, Sharma had demanded that Rs 1 lakh be paid initially, with the remaining Rs 2.5 lakh to be paid later. Acting on the complaint, the CBI laid a trap and caught Kotak red-handed while accepting Rs 1 lakh from the complainant.
Both Sharma and Kotak were arrested on January 16, 2009, and searches were conducted at their residences and offices.
After completion of the investigation, the CBI filed a chargesheet against the accused on November 26, 2009.
