BJP MP Dinu Solanki named key conspirator in CBI chargesheet
CBI has established in the investigation that Jethava was murdered at the behest of Solanki as the Saffron leaders illegal mining activities,including illegal lifting of soft muram in prohibited area,were being exposed.
Putting aside the “findings” of Ahmedabad’s Detection of Crime Branch (DCB) giving clean chit to BJP MP from Junagadh Dinu Bogha Solanki in RTI activist Amit Jethava murder case,the CBI chargesheet has named the parliamentarian as a key conspirator. CBI has established in the investigation that Jethava was murdered at the behest of Solanki as the Saffron leader’s illegal mining activities,including illegal lifting of soft muram in prohibited area,were being exposed.
The special CBI magisterial court handed over the chargesheet to Solanki on Saturday before the case was sent for committal to a sessions court to start the procedure of trial. The chargesheet states that CBI’s finding is largely based on Call Data Records (CDR) and statements of two witnesses whose identities and statements have been withheld by the CBI due to threat to their life,considering the clout of the BJP leader.
The chargesheet states,“…Solanki hatched a criminal conspiracy with accused Bahadursinh Dhiruba Vadher and Pratapbhai alias Shivabhai Solanki (nephew of Solanki; both were chargesheeted by DCB) at his farmhouse in Harmadiya village two-three months prior to the murder of Amit Jethava. It was revealed that accused Bahadursinh Vadher was very close to accused Dinu Solanki.”
The CBI officials’ claim is based on CDRs that reveal that Solanki and Vadher were constantly in touch before and after the murder. The chargesheet claims that on July 20,2010 — the day Jethava was shot dead — four SMSes originated from a cellphone used by Solanki which were sent to Vadher moments before the execution of murder took place.
CBI has stated that Solanki had a strong motive to murder Jethava. “The deceased (Jethava) started the crusade against personal and commercial activities of Solanki and his nephew. Investigation revealed that illegal mining activities were continuing in the prohibited 5 km area of Gir Forest and the deceased finally filed a PIL in the Gujarat High Court on June 28,2010,stating that illegal mining continued at the behest of Solanki.”
CBI further states that a month later,High Court issued notices to Solanki and his nephew on July 19. The chargesheet mentions that the notice infuriated accused Solanki and “he got him killed on the very next day on July 20,2010.”
“Thus,accused Solanki had a strong motive to eliminate Amit Jethava as he was very much annoyed with the activities of the deceased and accused Solanki had also threatened the deceased earlier on many occasions,but the deceased continued his efforts to expose Solanki.”
The case,initially investigated by Ahmedabad’s DCB,could find no evidence against Solanki. The DCB had chargesheeted five accused,namely Bahadursinh Vadher (police constable),Shiva Solanki,Salesh Pandya,a sharp shooter,Udaji Thakor and Panchan. Jethava’s father,Bhikhabhai,however,demanded further investigation to probe the role of Dinu Solanki in the High Court. The court,then,handed over the investigation of the case to CBI.
Solanki was arrested on November 5 in connection with the case. The chargesheet was filed in a special CBI court in Ahmedabad on December 21. Solanki has been charged under Section 120 B (criminal conspiracy) and Section 320 (murder) of the IPC.
