Opposing the applications of Zakia Jafri before a magisterial court here on Wednesday to present all investigation papers
of the 2002 Gulberg Society massacre case before the court,SIT counsel R S Jamuar said that amicus curiae Raju Ramchandrans report was a mere opinion which cant guide this court.
While the amicus curiaes report had suggested that there were enough evidence to prosecute Narendra Modi, the SIT gave a clean chit to the chief minister in its recently filed closure report before the magisterial court.
Jamuar was arguing on SITs opposition to provide missing documents from the closure report based on Zakias complaint.
Zakia, wife of slain former Congress MP Ehsan Jafri, had filed three applications seeking the documents which are said to be missing from the closure report containing 25,000 pages, including the preliminary report filed by SIT member A K Malhotra. It was Malhotras report based on which the Supreme Court ordered for further investigation.
In the final argument today,Jamuar said the applications are not specific. He said if the complainant finds that SIT has concealed certain documents from submitting in the final report,it is ready to face the charges.
On the other hand,Zakias counsel Mihir Desai alleged that the stand of SIT had changed over the years while claiming that the probe teams action were biased.
Both the advocates also argued on whether activist Teesta Setalvad should be allowed to examine the closure report on behalf of Zakia.
The court will pronounce the judgment on July 16.
