Ahmedabad court rejects anticipatory bail to Kartik Patel over deaths of PMJAY beneficiaries in Khyati Hospital

The Gujarat government on Monday said the district and sessions court in Ahmedabad has rejected the anticipatory bail plea of Kartik Jasu Patel, the absconding owner of Khyati Multispeciality Hospital, in all three cases filed against him on charges that include culpable homicide not amounting to murder.

The cases pertain to the deaths of two PMJAY beneficiaries after angioplasty surgeries at the hospital, which a panel of experts appointed by the state government found to be “completely unnecessary” and conducted “without informed consent from the families”. Apart from these two deaths, of Mahesh Girdhar Barot (52) and Nagar Moti Senma (75) of Boricha village of Kadi in Mehsana, 15 others from the village were also subjected to angiographies.

The FIRs had been filed at Vastrapur police station on November 13 and subsequently transferred to the Detection of Crime Branch (DCB) for investigation.

In its statement on Monday, the state government said Kartik Jasu Manilal Patel (59) of Khyati Multispeciality Hospital who has been absconding to date and is believed to be abroad, had filed for anticipatory bail in all three cases that came up for hearing before court number 1 of district and sessions judge K M Sojitra.

Notably, Kartik Patel is the Chairman of Ahmedabad Bariatrics and Cosmetics Pvt Ltd, the holding company of Khyati Hospital, and the only accused still absconding from the law.

The statement said that special public prosecutor Vijay Barot had cited various Supreme Court judgments in the government’s argument against granting anticipatory bail to Patel. The court rejected Patel’s plea in all three cases.

Notably, the 15 surviving victims of Khyati Hospital from Boricha village have approached the Gujarat High Court seeking that FIRs be filed on behalf of all of them against the accused persons from the hospital.
