Delhi HC asks Go First airline to give lessors access to documents
The National Company Law Tribunal On May 10 placed a moratorium on the Wadia group airline’s financial obligations and recovery of aircraft by lessors.
The main matter is listed for further hearing on October 19.

Delhi HC asks Go First airline to give lessors access to documents

In an interim order on Thursday, the Delhi High Court issued a slew of directions on applications moved by various aircraft lessors of Go First airline directing the Resolution Professional (RP) of the airline to provide access to the lessors of certain documents pertaining to the aircraft.
A single judge bench of Justice Tara Vitasta Ganju said that the RP in charge of the airline will provide within 14 days access to the lessors of documents relating to aircraft storage, to removal of parts, historical records, technical records and all documents pertaining to airworthiness of the planes.
Justice Ganju permitted the lessors to contract a 24-hour security service for all the aircraft at own expense. It added that the Directorate General of Civil Aviation (DGCA) shall permit the duly verified security personnel/security agency appointed by the lessors, access at the various airports in and around the country, where the aircraft are lying parked.
“The Respondent/RP of Go Air shall continue to maintain the aircraft as already directed,” the HC said, adding that these directions shall apply to the 54 aircraft mentioned in the order belonging to various lessors.
The court clarified that these directions are being passed in addition to the directions passed by the HC earlier.
The order came in applications by the lessors seeking urgent directions for full and proper access to and inspection of all aircraft documents, and records, including its maintenance record/storage preservation records.
The applications were filed by the lessors in their main petitions seeking de-registration of their aircraft by DGCA. The main matter is listed for further hearing on October 19.

On May 10 the National Company Law Tribunal placed a moratorium on the Wadia Group airline’s financial obligations and recovery of aircraft by lessors which was subsequently upheld by the National Company Law Appellate Tribunal (NCLAT) on April 22.
