In over 27 years of militancy, no Army or paramilitary forces personnel has faced a civilian court on charges brought by the Jammu and Kashmir Police. This is because the Centre has not given permission that is required under the AFSPA.
Three civilians were killed when army personnel opened fire at stone-pelting mob in Shopian last week. An inquiry was then ordered by the Chief Minister following which the J&K Police lodged an FIR under IPC. The FIR also names an Army Major.
