A division bench of Chief Justice Rajendra Menon and Justice V K Rao concurred with a single-judge bench’s findings that “the dominant purpose” for which Herald House on Bahadur Shah Zafar Marg in central Delhi was leased out to AJL “no longer exists”.
Subramanian Swamy, during his cross-examination by lawyers of UPA Chairperson Sonia Gandhi and Rahul Gandhi, both accused in the case, said that the Congress President held 35 per cent shares in YI when the firm took over AJL.
The plea, challenging the October 30 order of the Urban Development Ministry ending the lease and asking it to vacate the premises by November 15, is scheduled to come up for a hearing Tuesday before Justice Sunil Gaur.
