Now with the superannuation of Justice Chelameswar due on June 22, Justice A K Sikri will become part of the five-member collegium, necessitating the need of afresh reconsideration and decision to reiterate Justice Joseph's name back to the Centre.
Citing instances where judges of the Supreme Court were superseded and how recommendations of the apex court were turned down, he said: “I have written this blog so that my friends in the Congress party get an opportunity to look at the mirror.”
There are some indications that separate files could be sent — one for Justice K M Joseph’s name and the other for more judges. But it remains to be seen what the Centre does when it formally receives the reiteration.
"If a jurist of his calibre is not being elevated to the Supreme Court, then I don't know who should be. I am yet to see a jurist as learned and as humble as Justice KM Joseph," says Senior Advocate at the High Court Avtar Singh Rawat
The government Thursday returned for reconsideration the Collegium’s recommendation to elevate Uttarakhand Chief Justice K M Joseph to the Supreme Court even as it notified the appointment of senior advocate Indu Malhotra as a judge of the apex court.
