The government had countered the MHA and said the commission is legal as was constituted based on a decision by the cabinet. The matter is now in court, said a senior official.

Krishnan further said that as far as powers delegated to the state were concerned, the Lt Governor was bound by the advise of the Council of Ministers.

Senior advocate Dayan Krishnan, representing the AAP government, has argued that the Lt Governor “was not the elected representative” and could not act against the aid and advice of the elected government.
Kejriwal’s reaction comes after BJP MP from Northwest Delhi Udit Raj called the LG a “super king” who hardly had time for Delhi’s MPs.
