Facebook/WhatsApp data swap deal being probed by Spanish agency

Spain’s data protection agency says it will investigate whether the recently announced exchange of personal data between WhatsApp and Facebook meets Spanish data protection legislation.

The watchdog body said it will study what information collected from Whatsapp users is sent to Facebook, for what purpose, how long it is kept and what options customers are offered if they wish to object.

It said it will coordinate with its counterparts in Germany, Italy and Britain, which have announced similar probes.

Facebook took over the Whatsapp messaging service two years ago and announced recently that WhatsApp would begin sharing user data with the social network as part of a program to synchronize the two businesses. The agency announced its investigation in a statement Wednesday.

The report comes days after a Delhi court said that WhatsApp will not share users’ data collected under its old privacy policy over the years up to September 25, 2016, with Facebook or any other related company.

WhatsApp has been told to completely delete all data of users who choose to opt out of the messaging service after coming into force of its new privacy policy. The court said WhatsApp will delete users’ data up to September 25, even of those who choose not to opt out of the instant messaging app and agree with new privacy policy.

Facebook and WhatsApp facing trouble over this data-sharing in Germany as well. The German Privacy watchdog has ordered Facebook to delete whatever data it has received from WhatsApp. Unlike India where there are no specific privacy laws to deal with user data and how it shared, stored, etc, Germany has strict data privacy laws.
