A Christian nun,allegedly raped during the Kandhamal riots in Orissa,challenged the state High Court’s disinclination to hear her plea to cross-examine a Sub-Divisional Magistrate,a prosecution witness in the case.

A bench of Justices Altamas Kabir and J Chelameshwar agreed to hear her and sought the state government counsel’s presence on Monday.

In her plea,the victim sought cross-examination of the Magistrate,who according to the nun,had erroneously testified that one of the accused,Santosh Patnaik,“did not commit any other overt act.”
