SC refuses to stay Etisalat case heard by TDSAT

The Supreme Court on Monday refused to stay the proceedings against Etisalat DB before the telecom tribunal TDSAT over Reliance Infratel’s (RInfra) plea to recover Rs 1,200 crore from the operator for using its telecom infrastructure on lease.

A Bench led by Justice SS Nijjar admitted the petition against RInfra but said that the proceedings before the tribunal could not be stayed at this stage. RInfra had moved TDSAT in February,seeking to recover the amount due.

Etisalat DB had however challenged the jurisdiction of the TDSAT and claimed it could not sit over the dispute.

The tribunal had rejected this contention,prompting the company to move the apex court.
