No immunity cover,French official held on rape charge

An official at the consulate of France in Bangalore,who has been accused by his Indian-origin wife of sexual assault on their three-and-a-half-year-old daughter,was arrested on Tuesday morning following communications from the Ministry of Home Affairs and the French embassy that he did not enjoy diplomatic immunity.

Pascal Mazurier,a deputy head of chancery,was produced at the residence of the eighth Additional Chief Metropolitan Magistrate Sangana Gowda Patil in the evening and remanded to 14 days in judicial custody — after the police did not press for his custody for investigations.

The 39-year-old Mazurier has been accused by his wife Suja Jones Mazurier,37,in a complaint filed with the High Grounds police in Bangalore on June 14 of raping their daughter on June 13.

The charge has been supplemented with a medical report from a private hospital that states that semen traces were found along with physical signs of rape.

Mazurier was not arrested earlier due to confusion about his diplomatic status leading to protests by women and child rights groups before the French consulate in Bangalore on Monday.

A clarification sought by the police from the Home Ministry that was received on Monday stated that Mazurier did not have the immunity,clearing the path for his arrest and prosecution.

Following his arrest,Mazurier was taken to a government hospital for collection of a blood sample that is going to be subjected to DNA testing alongside samples of evidence collected by doctors at the private Baptist Hospital while examining Mazurier’s child on June 13.

The Bangalore police,who were initially reluctant to file the complaint by Suja Jones Mazurier,registered the FIR on June 14 only after pressure from lawyer,former MLA and rights activist Pramila Nesargi.

Suja Jones,who has three children with Mazurier and is expecting a fourth,has also written to the French ambassador that her husband of 12 years had been physically and emotionally abusive towards her since 2005 and that she is “a victim of domestic violence”.

She sought protection for her children,who are French citizens,and herself.

Sources in the police said that Mazurier has repeatedly denied the rape charge.
