Man avoids ramming SDM’s car,yet spends a night behind bars

Businessman Vikrant Kumar,26,a resident of Sector 44,had to spend Wednesday night in the Sector 34 police station although he managed to avoid a head-on collision with a car while driving his jeep.

The reason: the car in question belonged to the Sub Divisional Magistrate (East) and IT Director Tanvi Garg. Kumar was arrested by the police under Section 107/51 of CrPC on a complaint from the driver of the SDM in the evening. To his surprise,he was produced before the same SDM for bail. The bail was granted after his family friend,Jagdish Singh Diwan,gave a surety of Rs 10,000. She listed the next hearing to April 30. Kumar claims Garg’s driver overtook a car parked on the roadside and entered into his lane. “I stopped immediately when the SDM’s car came in front of my jeep.”

In the courtroom,Kumar after getting a bail,asked the SDM,“Is driving in my own lane a fault?” However,the SDM ordered him to be taken out of the courtroom and summoned Diwan. “You are his surety and he is misbehaving with me in court. Even then you expect me to bail him,” the SDM said. Diwan said Kumar was right. “He needs to know what is his fault for which he was kept in police custody for over 12 hours. He was driving his car in his lane,” said Diwan.

The SDM asked Diwan if he was present there when the incident happened. “I was not,but you were,so you explain what happened,” he replied. An agitated Garg,before sending Diwan out of the court,said,“Who told you that I was in the car? It is not true.”

A private guard of a hospital adjacent to the road where the incident took place said,“Two vehicles came from opposite directions,one was a government vehicle. Both were about to collide when they stopped. A few seconds later,both the vehicles went their way without a word.”

However,Kumar claimed that he had seen the SDM in the backseat of the car. “Later,her PSO Rajesh and driver Harjit Singh,told me in front of the police,that she was in a hurry to receive A P J Abdul Kalam and that is the reason she only noted the registration number of my vehicle.”

The driver had complained that Kumar got into a scuffle with him and the PSO. But Kumar was not booked for assault on a public servant.

SDM says she was not present in the car

When contacted,SDM Tanvi Garg said,“I am sitting with the ex-president and cannot talk right now. You may write whatever you want.” But later a statement issued by the Director,PR,said Garg “had no involvement in the said conflict between office staff and the accused booked”. It also said she was neither present in the vehicle when the conflict arose nor does she have any connection with the police action.
