Moving on the complaint by 58 members of the House,the Rajya Sabha on Friday admitted an impeachment notice against Calcutta High Court judge Soumitra Sen.
The case against Justice Sen is of financial impropriety. He is said to have accepted Rs 32 lakh as the court-appointed receiver in a lawsuit between the Steel Authority of India and the Shipping Corporation of India.
A three-member committee appointed by Chief Justice of India K G Balakrishnan had found the judge guilty of financial impropriety in retaining the amount even after being appointed to the Bench,though he had returned the money later.
Based on the committee’s finding,Balakrishnan had recommended his removal from office. Fifty-eight members of the Rajya Sabha had signed a petition asking for an impeachment motion against the judge after the Government had failed to initiate the procedure.
The decks have now been cleared for setting up a three-member expert committee to examine the charges against Justice Sen in accordance with Section 3 of the Judges Inquiry Act. The committee would be formed by Rajya Sabha chairman Hamid Ansari. The committee would comprise a judge from the Supreme Court,another from the High Court and an eminent jurist,sources said.
