AGL Kaul,the CBI investigating officer of the Aarushi Talwar and Hemraj double murder case,told a Ghaziabad Sessions court on Thursday that Aarushis mobile phone showed activity post her death but no details of the calls made were sought from the telephone service provider.
Rajesh and Nupur Talwar are standing trial for the murder of their 14-year-old daughter and domestic aide Hemraj in the intervening night of May 15 and 16,2008.
During the cross-examination by the counsel representing the Talwars,Kaul told the court of Additional Sessions Judge Shyam Lal,Details of the calls made from Aarushis phone after the night of May 15 and 16 were not sought,nor is there any record of these calls in any form of documentation.
Kaul also told the court that several items from the L-32,Jalvayu Vihar address of the Talwars were not seized as case property.
It is true that the toys that were found on Aarushis bed (where she was reportedly murdered) were not seized, he said.
The pink pillow that was on top of the bedstead in Aarushis room was also not seized,nor was the cooler panel (that was reportedly used to cover Hemrajs body on the roof) recovered. I had asked the accused for the sheet on top of the grill on the terrace of the house,but they said that they did not have it. It is true that on the day that the photograph of this sheet was taken,the sheet was there,but it wasnt seized, Kaul said.
Kaul was further questioned on the alleged dressing up of the crime scene.
He said,By the time I was handed over the case,the crime scene had been disturbed and changes had been made to the house. There is no record nor did any witness say that in the presence of Noida police officers did the Talwars clean the house on May 16,2008, he said.
He further told court that the Sector 20 police station sub-inspector Sunita Rana told CBI co-investigator Mukesh Sharma in a statement that,I do not know if anyone cleaned Aarushis room in my presence. But I saw that when Aarushis body was being taken for last rites. One person,aged 35-36,of medium height,took a broom upstairs and a group of people had tied something in a sheet,which was dripping,to throw it away. When I went upstairs to look,the drawing room was full of water,and 2-3 women and a man were mopping it up.
Kaul also denied the allegations levelled against him by Umesh,Rajesh Talwars driver,who had earlier told the court that he was slapped by Kaul in the CBI office,which resulted in a torn eardrum.
It is wrong to say that on October 16,2010,I called Umesh to the CBI office and assaulted him there,which resulted in injuries to his eardrum. It is also wrong to say that Umesh Sharma didnt identify the golf sticks and I made a fake memo in this regard, Kaul told the court.
