A case of conspiracy,wantonly provoking a riot,and rioting was filed at Bhesan court in Junagadh district against former chief minister CM Keshubhai Patel,Mahagujarat Janata Party president Gordhan Zadaphia and other Modi-baiters like Congress MP from Porbandar Vitthal Radadiya,Congress’s Babra MLA Bavku Unghad and Khodaldham trust promoter Naresh Patel on Thursday.

The complainant is one Bahadur Khuman,whose paan stall at Parab Road in Bhesan town was among the nine shops set ablaze on June 3 by a mob. Khuman has blamed the arson on the speeches made by these leaders at a meeting on March 11.

The Bhesan court will investigate the matter itself under CrPC section 202.

While his community leaders have affliliations with the RSS and BJP,the forty-something Khuman says,“I have no political affiliations or interest in politics. I just happen to be a victim who lost source of his income in political games.”

“A total 66 persons,including top leaders,have been accused of rioting,damage to property,inflammatory speeches and conspiracy under various IPC sections like 141,149 (unlawful assembly) ,120b (conspiracy),392 (robbery),436 (mischief by fire),452 and 153 (wantonly giving provocative speeches with intent to cause riot),” said Khuman’s counsel Rajesh Thakar.

Though the rioting occurred hours after Bhupat Bhayani,a BJP councillor at Bhesan Taluka Panchayat,was shot at on June 3,the complainant in the plea claimed it had roots in Leuva Patel community’s meet organised on

March 11 at Mota Kotda village near Visavadar where the leaders named in the case allegedly made inflammatory speeches. continued on page 2

Bhayani,who had received two bullet injuries on head,was attacked near Mangnath village near Visavadar while on his way back to his home at Bhesan,which is located 30 km away.

After the attack on Bhayani,markets were closed down in Bhesan and nine shops were set ablaze. While the police had registered a complaint of rioting against a mob of 200 persons,no police complaint then was filed by affected shopkeepers. Next day,when Bhesan shut down again,the police arrested three persons in connection with the firing incident — Suresh Kathi,Devku Odha and Bhupat Kathi.

“I have said in my complaint that though firing incident occurred near Visavadar,where the two communities have some property disputes,nine shops were set ablaze 30 km away at Bhesan. It was nothing but conspiracy,” Khuman said.

In his complaint,Khuman has quoted the leaders as having said in the March meeting,“Kathio ne nabood kari devu ache (We have to finish the Kathis (Darbars – a warrior community).”

The complaint,said Thakar,further said that these leaders,referring to history of rivalry between the two communities of Patels and Darbars over power and land,went on to say that “now new history will be created as we will not let our land fall in others’ hands”.

All the leaders named as accused in the case are currently at the forefront of an anti-Narendra Modi campaign.

It all began in January,when under leadership of Naresh Patel,an industrialist from Rajkot,Leuvas held a show of strength at Kagvad in Rajkot district,which is seat of their deity Ma Khodal.

Since then,these leaders,all Leuva Patels from the strong Patidar community,have been attending various functions in shows of strength.

The event at Khodaldham,which was the foundation laying ceremony for the temple,has seen a massive turnout.

Gordhan Zadaphia,when contacted,said,“We have not said anything at that particular meet. Besides,Keshubhai has been in public life for 55 years. But never have such complaints been filed against him since he has been a very responsible leader.”

Cops carry parallel probe

Apart from the court case,there will be a parallel inquiry by police following an application submitted by Kathi community members to Junagadh SP Dipankar Trivedi.

“The application has been forwarded by me to the police officers investigating the incident of riots at Bhesan on June 3,” Trivedi said.

The Junagadh police maintained they will try to get audio-video footages of the said Leuva Patels’ meet.
