Bombay High Court (HC) has refused to set aside proceedings initiated under Preconception and Prenatal Diagnostic Techniques Act against a doctor for allegedly disclosing sex of foetus to a pregnant woman. “I do not find substance in the application for quashing the proceedings,” said judge M L Tahilyani while hearing the plea of 66-year-old Dadarao Parwe of Sindkhed Raja in Buldhana district recently. During arguments, the judge noticed the first breach alleged against the applicant was that he disclosed the sex of foetus to a pregnant woman. As far as other breaches are concerned, the court noted the counsel for the applicant had not been able to place any material to show provisions of the Act had been complied with.
