The Pune Family court,in an unusual move, has issued a public notice in a Dominican Republic magazine against a former Supreme Court attorney who is allegedly absconding. The court took the step after repeated attempts to contact Karan Surendra Singh (40) failed. Karans wife Priya had moved court seeking custody of their seven-year-old son.
The Pune family court registrar wrote to the editor of the magazine,TheDominican.net,requesting him to publish the public notice,a copy of which is available with Newsline. The notice states,You (Karan Singh) are hereby given notice to file your appearance in Court at 11am on 18 April 2012,failing which the petition will be heard in your absence and determined ex parte. TheDominican.Net published the notice on April 2.
Priya and Karan were married at Karans hometown,Jabalpur,on January 28,2001. At that time,Karan was residing in Delhi and was an attorney practicing in the Delhi High Court and the Supreme Court.
Amit Bhowmik,Priyas counsel in Pune, said Karan and Priya left Delhi along with their son for Dominican Republic on September 23,2009. Karan has not returned since then,he said. He acquired Dominican citizenship and illegally possesses Indian and Dominican passports. He also acquired a passport and citizenship of Dominica for their son,who celebrated his seventh birthday on Tuesday, he said. Priya, however, was allegedly tortured physically and mentally by Karan. Unable to bear the stress, she returned to her parents home in Pune on December 11,2010.
Last year,Priya filed a petition in the Pune family court seeking for various reliefs, including the custody of their son. The family court has been trying to serve notices to Karan since then, but he is said to be travelling out of Dominica, because of which the notice cant be delivered to him, Bhowmik said.
A memorandum dated October 12,2011 by the Chief of Police of Dominica,Cyril Carrette,to the Prime Minister of Dominican Republic,Roosvelt Skerritt, confirmed that both Karan and their son were out of Dominica since February 3,2011 and travelled to Barbados and St Lucia. A copy of the memorandum is also with Newsline.
Priya also filed a criminal complaint against Karan on March 24 for allegedly wrongfully confining minor son, criminal breach of trust and cruelty.
