Chand used me,then divorced me: Fiza

Chand-Fiza saga took yet another turn with Fiza claiming that he had divorced her over phone and SMS.

In another dramatic turn to the Chand-Fiza saga,former Haryana Deputy Chief Minister Chand Mohammed divorced his wife Fiza over phone and through SMS,accusing her of making “false” allegations against him. However,Fiza said legal separation in this manner was “not acceptable”.

Chand faxed to PTI office in New Delhi two pages of “Memorandum of Divorce” sent to “Fiza Beghum” from Illford,Essex,UK saying he has divorced her through “telephone conversation” from the Notary Public Office there.

The divorce was also confirmed through SMS message sent to the two mobile numbers of Fiza,he said adding,two demand drafts have been sent to her — Rs 5 lakh as “mehr” and Rs 15,000 towards three months’ maintenance expenses starting from March 13,2009.

Earlier in the day,37-year-old Fiza told reporters in Mohali that Chand had telephoned her last night and uttered “talaq” (divorce) word three times.

She later said that she had not received any Memorandum of Divorce or the demand drafts.

Fiza said she had consulted Supreme Court lawyers and Muslim clerics who had told her that divorce through telephone and SMS message was “not acceptable”. “It should come before a Qazi (priest),” she quoted the lawyers and clerics as having told her.

In the memorandum,43-year-old Chand charged Fiza with levelling “false” and “highly objectionable” allegations against him. He also justified his having faxed the memorandum of divorce to the media by telling Fiza. “I am compelled to inform the press about the above said action taken by me as you have gone public,speaking badly about me.” Chand said the “vicious propaganda” launched by her has made it impossible for him to continue the marriage.”

You have even gone to the extent of making false and highly objectionable allegations against me publicly and even to the authorities,” Chand told Fiza.

He also justified his having faxed the memorandum of divorce to the media by telling Fiza. “I am also painfully compelled to inform the press about the above said action taken by me as you have gone public,speaking badly about me.”

Chand said the “vicious propaganda” launched by her has made it impossible for him to continue the marriage. The mehr was sent through a DD drawn on State Bank of India payable at Chandigarh. Another DD for Rs 15,000 was also sent with the MOD,he said.

Fiza said he should personally appear before her. “If he wants to give talaaq he should do as per Muslim rituals. This (through a telephone call and SMS) is not the right way.” She charged Chand with having misused Islam. “How strange … convert to Islam,marry a woman,use her body and then throw the woman out.”

Chand,formerly Chander Mohan,married ex-Assistant Advocate General of Haryana Anuradha Bali alias Fiza in December last year after both of them converted to Islam.

Chand was already married and had three children. They later fell out and Fiza filed a complaint with the Mohali police charging Chand with rape,cheating,defamation and hurting her religious sentiments. Fiza said on Saturday that she will file a fresh complaint with police as no action has been taken so far on the earlier complaint.

Chand in his memorandum told Fiza,”I have spoken to you today by telephone conversation,on the 13th of March 2009,from the Notary Public Office and in front (of) the Notary Public there.”

He said he called her on her mobile number. “You answered my call and I clearly told you three times: Talaq,Talaq,Talaq (I divorce you,I divorce you,I divorce you.)” The call was followed by an SMS message to her two mobile numbers,the elder son of former Haryana Chief Minister Bhajan Lal said.

“I also told you that because of your vicious propaganda and bad behaviour,it is not possible for me to continue in marriage with you and it is therefore that I have divorced you,” he added.

He said he was sending the memorandum of divorce “in confirmation of my above said conversation with you.” Fiza said,”I knew beforehand that this will happen. I am not able to understand what prompted him to this action as it was surprising that after professing blind love for me he did not care to come when I was in hospital.”

“He telephoned me last night and used talaq (divorce) word three times. His call came from a number which appeared to have been made from London,” Fiza said adding,he also sent an SMS to her mentioning ‘talaq’ in the text message.

“He talked to me briefly and his language was threatening and very impolite,” she said adding,Chand had offered her a compensation of Rs five lakh,which she refused.

“I will be filing a fresh complaint with the police since no action has been taken so far on my earlier complaint. He (Chand) has ruined my life. Yesterday,he also threatened me of dire consequences if I continued to rake up the case,” Fiza alleged.

Fiza had recently threatened to move court against Chand claiming that Mohali Police had failed to act on her complaint against him.

“I was not hoping to get any justice from police as they failed to act on my compliant against the sitting MLA (Chander Mohan is sitting Congress MLA from Kalka),” she had said four days back.

She claimed that Mohali police were under pressure from Chand Mohammad’s family.

However,Mohali Senior Superintendent of Police Jatinder Singh Aulakh had said acting on Fiza’s complaint,they had got an inquiry conducted by the SP (city) and even legal opinion was sought but they found no offence by Chand Mohammad and hence they “will not file any case against him”.
