Professor GN Saibaba
The Supreme Court on Monday released on bail Delhi University professor G N Saibaba, arrested for alleged Maoist links, on medical grounds. It also pulled up the Maharashtra government for its insistence to keep him behind the bars without any reasonable argument.
“You have been extremely unfair to him (Saibaba)… especially knowing his medical conditions. Why do you want him in jail if key witnesses have been examined? You are unnecessarily harassing the petitioner,” remarked the bench led by Justice J S Kehar as it shot down Maharashtra government’s attempt to oppose the bail.
The counsel for the Maharashtra government had opposed the bail, contending that some witnesses in the case were yet to be examined and that they apprehended Saibaba would propagate Maoist views if set free.

But the bench noted that all the material witnesses had already been examined and that there was no basis for keeping him confined anymore.
“How do you know what he will be doing when he goes out? You cannot say he will do this or do that,” responded the court while turning down the plea to prolong the incarceration of the professor.
Granting bail to Saibaba, the court said that his release would be subjected to conditions laid down by the trial court as he would make himself available as and when he required.
Arrested in May 2014 from the Delhi University campus, the wheelchair-bound teacher was lodged in Nagpur jail.
