In a setback for Gujarat government, Central Administrative Tribunal (CAT), Ahmedabad bench, Friday held that the chargesheet against ex-IPS officer Rahul Sharma for keeping with him crucial CDs in the 2002 riot cases was “tainted by mischief” and “coloured by malice and mala fides”. Scrapping the chargesheet against the ex-IPS officer, the bench slammed the state government and said even if Sharma kept the CDs with him in 2002, why its officers probing the riot cases kept a “collective silence” till those were placed before Nanavati commission. The commission had accepted the CDs as evidence.

The order came on a petition moved by Sharma, who took early retirement last year and is now a practising lawyer, challenging the chargesheet filed in 2011.
