NDTV India ban: SC defers hearing for December 5

The government on November 7 put on hold its order asking NDTV that its Hindi channel would be shut for 24 hours on November 9 for allegedly flouting norms.

The Supreme Court on Tuesday adjourned the hearing of a plea challenging a day’s ban on NDTV India to December 5 as Attorney General Mukul Rohatgi told the court that government was considering a plea for review of its decision.

“There is no real urgency as their plea (by NDTV) for review of the decision is being considered by the government,” Attorney General Rohatgi told Justice A.K. Sikri.

The government on November 7 put on hold its order asking NDTV that its Hindi channel would be shut for 24 hours on November 9 for allegedly flouting norms. NDTV India was ordered to go off-air as government accused it of broadcasting sensitive details of January’s terror attack on the air force base in Pathankot. The channel has refuted the allegations and pointed out that other channels and newspapers reported the same information.

The ban has been widely condemned by journalists and editors with all press councils drawing parallels to the Emergency of the 1970s when basic constitutional rights including the freedom of the press were blatantly violated.

After a large protest held by journalists from every major media organisation in Delhi, the Press Council of India said the government’s action amounts to “uncalled for censorship” at a time when “press freedom is already under increasing threat in the country.”

Last week, when the ban was announced, The Editors’ Guild of India said the order was unprecedented and that the centre appears to have given itself the power “to intervene in the functioning of the media and take arbitrary punitive action as and when it does not agree with the coverage.” The organisation, a grouping of the editors of all major newspapers and magazines in the country, said if the government finds any media coverage objectionable, it can approach the courts.

Defending the ban, Information and Broadcasting Minister Venkaiah Naidu has said that it is “in the interest of the country’s security” and that the barrage of criticism confronted by the government appears “politically inspired.”

              It is in interest of security of India, Judiciary must issue some guidelines to Print and Electronic Media as how to report sensitive issues concerning security of India when News Channel like NDTV cross all limits and reports matter to public without censoring its effect on security of India and helping our enemies to carry out their mission successfully after receiving information from News Channels as seen during 26/11 Mumbai attack by stani Terrorist killing Police Officers and civilians.Freedom of expression should not damage the security of India at any cost.There must be some guide lines to Journalist in reporting matters like Communal cles,Terrorists activities which harm and damage peace in country and integration of India.Matter in SC should not be closed down even there is compromise with Govt by NDTV.It has done more harm than good.

                  The voluntary suspension of ban by the goverment shows that, unlike its sympathisers and Bhakts, Modi government itself is not bothered about any imminent threat to National security by "the pseudo secularists’ journalist". This may be a situation where Modi government is not interested in fulfilling desires of its own sympathisers and Bhakts. Modi government may be incompetant to show immediate results and / or not giving Acche Din of instant results to its own sympathisers and Bhakts.

                        Once the govt. has taken the decision to ban the channel due to national security it should not be taken back.It show from the body language of minister Mr. Naidu today that they were not fully prepared for this ban legally clearly shows the weakness of the government or he is speaking under pressure.Why on hold now ?lt;br/gt;Mr. Naidu should speak less and work more like Mr. Modi.lt;br/gt;A.G should also be replaced who is not fit for his job as Mr. Swami told in the past.

                                          The Ban on NDTV should not be withdrawn as it is being opposed by only those from the pseudo secularists’ journalist and by the opposition parties. Their false propaa about danger to freedom of speech is childish and illogical. Broadcasting the real-time operational details of counter terrorism actions to help the terrorist handlers does not fall in the ream of ‘freedom of speech’ or ethical journalism. The Govt has not banned anyone from the media from playing havoc with Governance by misinforming and giving ill-informed opinions and views besides giving platform for anti-nationals and even stanis to abuse the elected PM and the Govt on 24x7 basis . Regrettably, all this goes by the name of 'Freedom of speech’. The Govt should let the SC decided ones-for-all whether such kind of reporting and biased journalism harms the nation's interest or it only strengthens democracy, and also, whether aiding terrorist’s under the garb of freedom of speech endangers lives of security personnel and innocents .

                                            Undoubtedly courts in this country work in league with pressutes and your presumption would have proved correct. But mind it , ban was not for any criticism of Modi or govt policies but for compromising national security for which NDTV is habitual offender and did same during Kargil or Mumbai terror attack.
