Don’t lay off or demote employees for disability: Centre

It also makes it mandatory for the government departments not to deny promotion to "a person merely on the ground of his disability".

No government office should dispense with or reduce in rank an employee who acquires any disability during his service, the Centre has said.

The Department of Personnel and Training (DoPT) has amended Central Civil Services (Pension) Rules, 1972, to make it easier for such employees to continue in service or to get invalid pension — which is granted if a government servant retires from the service on account of any bodily or mental infirmity which permanently incapacitates him for the service.

“The case of a government servant acquiring a disability, where the provisions of Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (1 of 1996) are applicable, shall be governed by the provisions of the said section,” says the recently amended Pension rules.

The Section 47 of the Act mandates “no establishment shall dispense with or reduce in rank, an employee who acquires a disability during his service”.

It also makes it mandatory for the government departments not to deny promotion to “a person merely on the ground of his disability”.

If a government servant, in a case where the provisions of the Section 47 of the Act are not applicable, retires from the service on account of any bodily or mental infirmity which permanently incapacitates him for the service he may be granted invalid pension or service gratuity depending upon the length of his qualifying service on the date of retirement, the new rules said.

In case a government servant applies for an invalid pension, he shall be required to submit a medical certificate of incapacity from a medical board.

    During 1989 , some high officials ociated to Congress Government (PM-Rajiv hi period ) , Terminated 43 to 47 employees of Oil India Limited , Bay Exploration Project , Bhubaneswar ( a Govt Of India Undertaking ) from their jobs illegally ,with the plea of saving money , whereas everybody is aware of Scam /commission in BOFORs Case by Congress at that time . Congress (Rajiv hi) made these Oil India Ltd Bhubaneswar Employees jobless throughout their life , equivalent to emotionally handicapping . some people even died due to starvation because of no income . other people had to resort to some other professions and perish.. Thank God that we Indians got Modi-ji as our Strongest Prime Minister , now we feel ourselves that we belong to a Powerful Country , especially after the most desired Surgical Strike on stan..before in Burma...now no neighbour will even dare to look to India enviously .lt;br/gt;However, if Modi-ji could open this small case of harment made by Rajiv hi-PM to the 43 / 47 employees of Oil India Ltd , BEP , Bhubaneswar in 1989, give some relief or employment to the retrenched persons / their family , they will ever obliged to Modiji .lt;br/gt;(my ph no. 7008588703 )

    There is no job for the able ones, why you are talking about laying off of disabled? Where are the investments coming to give employment to the unemplo? All those 'Make in India' funds spent on advts. and exhibitions are wasted ?

    It is a good decision for the pursuits of government employees and will be helpful to expel them on the ground of disability and mental, who are deprived of their livelihood due to ejecting out from their job.
