Asaram case: SC declines to order CBI probe into missing witnesses

A bench of justices Anil R Dave and Adarsh Goel said it could be raised before the Allahabad High Court as complaints on it have been lodged in Uttar Pradesh.

The Supreme Court Friday declined to pass a direction for a CBI probe into the mysterious disappearance of a prosecution witness and assaults on other witnesses in a rape case involving Asaram. A bench of justices Anil R Dave and Adarsh Goel said it could be raised before the Allahabad High Court as complaints on it have been lodged in Uttar Pradesh. If such a petition is filed, the High Court is requested to look into it and dispose the same on merits.

After the bench gave the liberty of approaching the High Court, Bennet Castelino, who had filed the petition agreed to withdraw it. “In the circumstances, it will be appropriate if the petitioner approaches High Court of Allahabad by filing a petition with a similar prayer,” the bench said, noting that the FIR relating to disappearance of the witness was filed in Uttar Pradesh.

    The security of the witnesses may be prime concern and the rest of the witnesses may be given police protection. But Sir, the best way to end this menace is to record their statement before the judge hearing the case and the shall be save, because in case the defendants want to cross question, then they would need the witness in person and none would like to arm them.

      Satish wadhwani, a witness against bapu ji, is arrested by JandK police, its a great news for bapuji followers but media writes the headline as " the former istant of asaram got arrested". this headlines conveys as bapuji is again in a trouble but it was favourable news for bapuji and us. Dear Indians, think first that the criminial like people are alleging on bapuji and chep media is helping them. Shame on this media. This

          bennet castelino... this name is not related with this case nor he is any relative of anybody related with this case. its good to know about his interest. this need to be checked motive behind this person. A Christian missionaries agent is behind this fake case. I think this person should be investigated first.

            this peioner even told the court that he was in constant touch with Rahul sachan. yhis proves that the all witness against bapuji are working on instruction by these agents. Indian media also funded by these NGO and missionaries.
