Defamation case by Arun Jaitley: Delhi HC fines Arvind Kejriwal for delay in response

Arun Jaitley had filed a civil defamation case against the Delhi Chief Minister objecting to the use of a derogatory word by Kejriwal's lawyer, Ram Jethmalani in court.

The Delhi High Court on Monday levied a fine of Rs 5,000 on Arvind Kejriwal for delay in filing his reply in the civil defamation case filed by Arun Jaitley. The Finance Minister had filed a civil defamation case against the Delhi Chief Minister objecting to the use of a derogatory word by Kejriwal’s lawyer Ram Jethmalani in court.

The Delhi High Court had sought Kejriwal’s response as to why the defamation proceedings should not be initiated against him. During a cross-examination by Jethmalani of the Union Minister before Joint Registrar in the Delhi High Court on May 17, Jethmalani had used the term ‘crook’ to which the senior BJP leader took offence and filed a civil defamation case. The Joint Registrar had asked the AAP leader to file his reponse by July 26.

Due to an apparent delay by Kejriwal in filing his reply, Jaitley’s counsel Manik Dogra brought the delay to the court’s notice. The counsel further submitted that these were delay tactics on the part of the chief minister. The court has now fixed the matter for October 12. Kejriwal, in his reply to the defamation suit – filed through advocate Anupam Srivastava – submitted that the Union Minister’s suit “is liable to be dismissed as no civil action for damages for slander lies for any statement in pleadings or during the conduct of a suit against a party or a witness in it,” as reported by PTI.

The AAP leaders had earlier accused Arun Jaitley of corruption during his tenure as the President of the Delhi and District Cricket Association (DDCA), a post which he had held from 2000 to 2013. Jaitley, who had denied all the allegations levelled by AAP in December 2015, had filed a civil defamation suit seeking Rs 10 crore damages from Kejriwal and five other AAP leaders, claiming they had made “false and defamatory” statements thus maligning his reputation.

    Really do not understand what useful purpose is served by a fine this low. A fine of Rs. 5 lacs would have been more appropriate.

      Glad to see bhakts barking after a long time....because all these days. Bhakt were unable to bark since people were looking for bhakts during petrol price hike, while kids died in UP, riots in Hariyana etc.....

          Simple message is BAKWAS BAND KAR AUR APNE GIREBANME ZANK. His bakwas is bound to land him in jail- a VVIP jail like Sasikala Alka. He can call someone for massage like Ram Rahim or Asaram or Lalu. So cheer up baby. You have nothing to lose but your shirt pant and mufler. You can even write a research paper as to whether Modi has passed 7th standard or 6th.

            All financial misconduct happened in DDCA for ten years when jaitley was its president. Even Lodha Committee found serious financial bunglings in DDCA's functioning. Can Jaitley escape responsibility for such misconduct? And by the way why no defamation case against Kirti Azad who leveled much more serious allegations against FM? But you blind bhakts are blind to these facts and simply keep posting trash on social media.

              Ordinary people get punishment like expulsion and VVIPs deserve better treatment as they can afford to lose public money and there is no question of losing prestige as that S. Jain has stripped him of it and naturally he will not find ANY time to file a suit or A criminal case, the reason being- NIRLAJJAM SADA SUKHI. You may get help for translation from P. C. KULKARNI
