CRPF IG Rajnish Rai, who called Assam encounter fake, is shunted

CRPF IG Rajnish Rai, who called for a probe in what he alleged was a fake encounter — by a joint team of Army, CRPF, SSB and state police in Assam in March this year — that killed two men, has been transferred out of the North East with immediate effect.

Rai was asked to join the Counter Insurgency and Anti Terrorism (CIAT) School of the CRPF at Chittoor in Andhra Pradesh.

On May 24, The Indian Express first reported that Rai had told CRPF headquarters and other authorities that a “discreet enquiry” conducted by him — backed by GPS data and interviews with those involved — found that two suspected NDFB(S) cadres were killed in a fake encounter on March 30 near Simlaguri village in the Chirang district of Assam.

Rai’s report, dated April 17, said that the two men were picked up from a house in D-Kalling village and killed in cold blood. Calling for a full-fledged investigation, Rai alleged that weapons were planted on their bodies.

The Indian Express visited the village where a farmer’s family said that the two suspects were sleeping in their home when they were taken away by “soldiers” on the night of March 29.

Not just Rai’s transfer, the manner in which it has been done raises questions.

On Monday, CRPF headquarters sent a communication to its DIG in Guwahati that IPS officer Prakash D, who joined the force that very day on deputation, would reach the state capital for a “familiarisation programme” on Tuesday and that accommodation and vehicles must be arranged for him.

Once Prakash D reached Guwahati, Rai received transfer orders — dated June 12, 2017 (Monday) — to join CIAT in Chittoor.

Curiously, the order said that Prakash D was actually appointed as IG (Communication & IT) but would hold additional charge of Rai’s post. It said that the handover of charge must happen immediately. It added that the familiarisation exercise — the purpose for which Prakash D had travelled to Guwahati according to the first communication — could be held later.

Curiously, both orders, the one about Prakash’s going there and Rao’s transfer were issued the same day.

When contacted, Rai confirmed he had received the transfer order this evening but declined to comment further.

Despite repeated calls and messages, CRPF DG RR Bhatnagar did not respond.

Rai’s report on the alleged fake encounter was marked to Assam Chief Secretary V K Pipersenia; then acting CRPF DG Sudeep Lakhtakia; Lt Gen A S Bedi, GOC, 4 Corps & Chairperson, Operational Group, Unified Command; Assam DG Mukesh Sahay; SSB DG Archana Ramasundaram and CRPF ADG (NE Zone) Mohd Javed Akhtar.

The report said that GPS records show how a CRPF unit of the CoBRA visited the encounter spot in Simlaguri a few hours before the encounter. “It leads to the suspicion that the CoBRA team was trying to identify a suitable location where the alleged encounter with the NDFB(S) cadres could be stage managed,” Rai’s report said.

It also claimed there were witnesses who identified the bodies of the two suspects and confirmed they were picked up from D-Kalling village. It said these witness statements were in safe custody of the IG and would be presented before an independent investigating agency.

In his report, Rai observed, “Had this unlawful act been committed by a group of a few deviant officers, I would not have been so concerned. However, since multiple security agencies were involved in this incident, it indicates a deeper institutional malady in the functioning of the country’s most prestigious security forces. It represents a dangerous deterioration and degradation of institutional processes.”

    Now the question aries that who actually is a terrorist, just for getting promotion they misuse their power and can kill any innocent person......... Where is Law Order. What is the reason behind the transfer order???? Terrorist problem in north-east, this is one of the reason why youth pick up arms and lives a separate life in the jungle (what we call 'terrorist'). There are many cases but this one focus out and it is sure that nothing will be gained by the victim. No justice....

      Extra Judicial killing are giving Bad name to India.Why dont our Police and courts act like when they used to act during British era.The Britishers with these law effectively convicted Criminals.

          Another example of silencing the truth!!! So many lives have taken in stage managed extra judicial killings in many parts of India, especially Kashmir, Gujarat, Rajasthan, Assam, Maharastra. No questions were asked and if any good officer dare to speak he will be removed. This kind of actions from our forces/govt is not patriotism, rather anti national activities. This action will fuel more rebels and sympathisers. Remeber the words of Colonel Purohit? "You don't know who you are fight against?" to the officer who was arresting him. It says all. Chaddis are every where in the Indian system.

            This is not the first case of its kind in Assam and in the north-east. There have been quite a few cases of this kind that came up before the Guwahati High Court which after hearing them, has ordered government to pay compensation. Cases of similar nature and some of them even worse, in Manipur, were gone into by the Supreme Court appointed commission headed by retired justice Santosh Hegde. The facts of such cases were established by the Commission and were before the Supreme Court when it ordered that F I R's could be a registered in areas covered by AFSP, thus puncturing for the first time, the concept of immunity.

              This Rai , IG of CRPF should resign and join some NGO for protecting terrorists. He is unfit to be in CRPF. As a commander he should protect his soldiers. His job is to protect soldiers and kill terrorists. But he is doing reverse. Perhaps he is from JNU.

                Is he from JNU too?!! Than it must be a great university. Every honest seems to b from there. How do they produce so many civil servants. I heat the foreign secretary of India is also from JNU. Earlier i doubted the university's credentials, but now I would want my daughter to qualify it's entrance.l, which is hard as I hear. But women do get 5 grade points extra in the exam, that's how there are more girls than boys in JNU I hear. Jai Hind.

                  For those who are familiar with working of the government , nothing new or surprising has been reported . Ours is a broken system , the wheels of justice turn ever so slowly that the people pursuing it , are crushed by the inertia and backlash of the vehicle of justice . It is commendable that despite that there are many who pursue justice for its own sake . A quote by american Harper Lee "Real courage is when you know you are licked before you begin but you begin anyway and see through it no matter what' . While there are may be people who will argue that there must be a leeway for people who'fight" for their country and protect us , these are the exact arguments s , white suprmacists , brahmins (save our religion ), mullahs , islamic terrorists( save religion from infidels) use. Justice is difficult to achieve in our world but its pursuit must be encouraged by all , keep it up Rajnish Rai , may you find justice for your victims .
