Additional sessions judge D R Mahajan sentenced two labourers Ramesh Madavi and Suresh Madhavi (22) who were working at a site in Lavasa,for murdering their contractor Birju Madavi and three years’ rigorous imprisonment for assaulting Suresh Narute with sharp weapons in 2008. The court convicted the accused even after Narute had turned hostile during the trial.
According to the prosecution,Suresh was trying to convince the deceased Birju and Narute to make him a co-contractor,but they had refused. On March 8,2008,the contractor distributed salaries to the labourers. However,Suresh,as expected,received only the salary and not the contractorship amount. A quarrel had taken place between them that night after which Suresh stabbed Narute and Birju with a knife. Another labourer Malu Pungati had lodged a complaint.
Narute told the court that he was taken to the hospital along with deceased Birju because his back was hurting due to a previous injury. He avoided making any statement against the two accused in the court. The court,however,observed that there was other corroborative evidence and circumstantial evidence to hold the accused guilty. These included the knife that was used for murder,their blood-stained clothes,register of the primary health centre at Dasave where the two injured were first taken after the assault.
Both the accused had denied the allegations saying that they were falsely implicated. A total of 14 witnesses were examined by additional public prosecutor S B Patil to prove the charges. These included the panch withnesses,the doctors of Sassoon General Hospital and Dasave primary health centre and the complainant. The court awarded life term to the two accused under section 302 (murder) along with Rs 500 or additional one month imprisonment and three years rigorous imprisonment under section 324 (voluntarily causing hurt with dangerous weapons) of the IPC.
