A magistrate court has issued an issue process against a woman who allegedly provided false information about her expenses in a domestic violence case with an alleged motive of getting a fatter alimony. Issue process ,a legal term,means the court has taken note of the private complaint and has directed the other side to appear in the court.
The complainant,a city-based 39-year-old design engineer,had submitted to the court that his wife had submitted to the court a false affidavit claiming she had spent most part of the Rs 5 lakh given to her by the husband for saving,on paying the fee of their daughter. However,the husband filed an RTI query with the school and found out that the woman had spent no money for paying daughters fee.
In his complaint,the engineer had said that the wife suffers from arthritis and for last 11 to 12 years,the two have been staying separately. He has claimed that when the two enjoyed good relations,he had sent her Rs 5 lakh. The husband was then working in Germany. He has submitted that his wife filed a claims case in the JMFC court in Pune under the Domestic Violence Act,2005. And,he has also filed a divorce petition before family court in Pune and its currently pending in the court.The complainant submitted before the court that the wife had submitted before the JMFC court that of the Rs 5 lakh handed over to her by the complainant,she had spent most of the amount towards paying the donation fee to the Bharatiya Vidya Bhavan School in Shivajinagar for the admission of their daughter.
The husband has also submitted the reply of the school alleging that action should be taken against the complainant for providing false and misleading information to the court, said advocate Devanand Dhokne,counsel for the husband.
