Remarks against minister expunged.

In a relief for state minister Jaydatta Kshirsagar,also chairman of Maharashtra State Road Development Corporation (MSRDC),Bombay High Court (HC) has expunged certain adverse remarks made against him last year in relation to a toll contract in Solapur.

Hearing a review petition,HC observed the minister was not the chairman of MSRDC at the time. MSRDC said Kshirsagar was appointed to the post only on November 9,2010.

“It is clear the observations are made against MSRDC,not against the chairman in his personal capacity and therefore,we are inclined to expunge the remarks,” said a division bench of justices V K Tahilramani and Sadhana Jadhav.

In 2011,highest bidder Jai Laxmi Constructions had moved court questioning the award of a toll contract for Solapur Integrated Road Development Project to Shree Swami Samarth. HC said on August 6,2012,the action of the MSRDC chairman in awarding the contract was “arbitrary,irrational and unreasonable”.

“The chairman ought to have acted reasonably,fairly and in public interest in awarding the contract,” a bench comprising justices DD Sinha and VK Tahilramani said,adding that the action caused loss to the public exchequer.

In the review petition,Kshirsagar defended his stand saying the remarks made by the court pertained to the period between February 2009 and August 2009,when he was not the chairman of MSRDC.
