Devendra Fadnavis government scraps quota for Muslims in education

The BJP-led government in Maharashtra has scrapped an ordinance providing reservation for Muslims, despite the Bombay High Court allowing quota for the community in educational institutions.

The Devendra Fadnavis-led government, which had earlier said that it was against reservation on religious grounds, did not indicate if it plans to introduce a law to replace the ordinance, which lapsed in December last year.

“The ordinance dated December 23, 2014 could not be converted into an Act. In view of this situation, we have decided to scrap this ordinance,” said a circular issued on Tuesday by the General Administration Department.

In the run up to the Assembly polls last year, the previous Congress-NCP government had issued an ordinance on July 11, 2014 allowing 16 per cent reservation for Marathas and five per cent for Muslims in government-run schools and colleges as well as jobs.

The previous government had decided to provide a five per cent reservation to 50 Muslims communities by including them under a newly formed category — Special Backward Category-A.

The decision was challenged in the Bombay High Court which, in a judgment on November 14, struck down reservation for Marathas, but allowed five per cent quota for Muslims in educational institutions, but not jobs. Meanwhile, a new government came to power in the state.

The new government challenged the overturning of quota for Marathas and appointed a committee to suggest potential solutions, but did not make a similar move to examine the HC order on Muslim reservation in jobs.

The state government also allowed the ordinance to lapse on December 23 and chose not to extend it, thus forfeiting a chance for Muslims to obtain reservations in the education sector as allowed by the High Court.

In a three-page order, the state government stated that the Bombay High Court has set aside a clause of the ordinance that provides for five per cent reservation for the community in government jobs and, therefore, it has taken the decision to scrap the ordinance.

Fadnavis had earlier claimed that his government stood for the all-round development of Muslim community and the present reservation system would only help a section of the community. “Since there was confusion over the issue and over whether reservations can be granted on grounds of religion, we are in the process of consulting constitutional experts,” he had said.

Officials in the State Minority Development Department said there was no immediate plan to allow reservation for Muslims in Maharashtra. Principal Secretary Jayashree Mukherjee declined to comment on the issue. Fadnavis, too, was unavailable for comment.

Interestingly, the CM had on Tuesday held a meeting to discuss ways of ensuring the development of minorities in the state. The government’s move, meanwhile, came under fire with former minority development minister Arif Naseem Khan branding the government “communal”.

“The CM announces that the development of the state is not possible if condition of Muslims does not improve. On the other hand the government is doing all that it can to ensure that Muslims remain backward. The demand and need for reservations for Muslims is based on empirical and sound data. It is the communal nature of the government which is creating a hurdle in their rights,” Khan said.

The previous government had decided to provide reservations to Muslims based on the recommendations of the Mehmood-ur-Rahman committee, formed to assess the socio-economic conditions of Muslims in Maharashtra.

The committee, which took five years to come to a conclusion, had recommended eight per cent reservation in the state, education and housing — both public and private. It had also asked for an anti-discrimination Act for Muslims on the lines of the Atrocity Act.

      Muslims also fall under OBC category then why again reservation based on Religion... and if at all tere is any reservation then it should based on ECONOMIC Standards

                  Reservation should give to all needy people. but it should be limited to till School education only & school must be efficient & competent.reservation strictly neither in jobs nor in higher education.

                    Sandeep Bro...with all due respect....if what you have provided is the actual figure after all these years of reservations, then this sole reason is enough for it to be sped, and looked into from an economic angle.. short, it should (have been) be always reservations based on the economic status of one's family. Also, reservations in other divisions need to be seriously revised, bringing in the economic aspect rather than religious/caste or what not. Stop dividing the country!

                        I am not interested in if there is reservation for hindu or for muslims. Caste based reservation must be removed, reservation must be made on economical conditions what ever the caste might be.

                                When the name m0slims comes it eventually becomes pain in heart for saffronities, m0slims is not a religion, islam is? but since they wanted to oppose it, they made m0slim a religion, who is holding the govt. to do a economic health survey of m0slims, it was actually carried by various commission and the data showed some startling fact about poor economic, health, literacy conditions of m0slims, but since they are m0slims they cannot be considered under other backward cl, they should remain backward so that the communal politics goes on for saffronities and the likes owaisi and others to reap benefits during elections, what I'd suggest it is time to s all reservation, and provide help on the basis of actual economic health.

                                    which means I am right, Tushar your belief and honesty is good, but what about others OBC, ST ,SC are they following the same who have enough but still got reservation lollipop to get into any department, education, they desire.

                                      This reservation and quota system breaks the human spirit of achieving higher goals. Provide community upliftment opportunities at local levels and let all compete for seats at center for higher seduction. Non compeive persons suffer humiliation, depression and become subject of ridicule leading to other incidences. Give everything possible to uplift socially disadvantaged persons to solidify foundation - before admitting to higher education & jobs. Give intensive job training before giving full responsibilities otherwise inefficiencies and corruption will increase.

                                        after independece muslims were facing job crisis many muslims were struggling for jobs god gave them oppourtunity they went to gulf and become lavish rich people this quota also what happens many muslims will go to gulf and become rich and lavish people and they will take india to become more prosperous country muslims of india went to gulf and become business tycoons also history has shown indian muslims are the best people of world

                                          A Muslim reading your headline feels they've been cheated by the Maha Govt. Its an ordinance of reservation put forward by the previous government which has lapsed. Grow up to treat things as they are and not create communal divides by giving HOT headlines.

                                            Pls stop giving quota for monitory, form the bringing congress started quota for monitory only what about Hindus in India hindus are not geting any quota but monitory are geting monitory forn 1947 to 2015 what about other religion like Christians, Sikhs, Buddhists, Zoroastrians (Parsis) and Jains pls make equal quota for monitory (Christians, Sikhs, Buddhists, Zoroastrians (Parsis) and Jains)
