Dinesh Mody,89,chairman of Alkesh Dinesh Mody Institute of Financial and Management Studies (ADMI) has moved court to challenge the appointment of its director.
Dr S V Ratnaparkhi was appointed as the director,through a letter issued in February.
The institute,under the Mumbai Universiy,is located in the Kalina campus in Santacruz and was set up in 1994 as a department of the varsity. Dinesh Mody had set up the institute in memory of his late son Alkeshbhai by making a donation to the university.
However,Mody now claims that since 2004,he has been kept out of the decision-making process of several key posts in the institute. It was addressed in a letter by the university in September 2004 to the then director-in-charge which said that cases which require immediate attention should not be referred to the chairman.
Mody claims that prior to 2004,all appointments were made in consultation with him. He has challenged the present directors appointment on the grounds that he does not hold an MBA degree,which is mandatory for the post. The letter also stated that the same person was earlier rejected by the university in 2003 when interviews were held for the post. Instead,Vivek Deolankar,who is at present the head of the commerce department of the university,was appointed. However,he did not take up the post for six months.
According to the petition,the university vice-chancellor had not made Dr Ratnaparkhis appointment as a second option. Mody further claims that his present appointment is on the basis of the interview held in 2003.
Mody demands that a governing body should be constituted to take independent decisions with respect to the smooth functioning of the institute. He also wants the appointment of the director to be set aside.
A division bench of Chief Justice Mohit Shah and Justice N M Jamdar has issued notice to Dr Ratnaparkhi and has kept the matter for hearing on June 28.
