Fugitive underworld don Dawood Ibrahim’s brother Iqbal Kaskar, recently arrested and booked for extortion by the Mumbai Police, was granted bail by a magistrate’s court on Monday.
Kaskar was arrested on February 3 for allegedly attempting to extort Rs 3 lakh from a real estate agent in Byculla and assaulting him.
Claiming the case was merely a “figment of the childish imagination of the police”, Kaskar’s lawyer claimed the police’s remand application lacked any strong argument.
Kaskar alleged that the complainant in the case was an extortionist himself and and had extorted money from a doctor in the city. “The fact is known to the police and they have recorded the statement of the doctor on February 3, 2015,” the bail application said.
Moreover, Kaskar alleged, the police had initially booked him under bailable offences and later, only to keep him in custody, added fresh charges under Section 387 (for threatening to kill to commit extortion), 342 (wrongful confinement), 327 (causing hurt to extort property) of the Indian Penal Code.
While opposing the bail, the police submitted there was a threat to the complainant’s life because Kaskar is the brother of a notorious criminal. The police also said they apprehended that Kaskar could flee India and return to Dubai, from where he was deported years ago.
The police also stated that there were three other complaints against Kaskar and, if released on bail, he may intimidate the complainant and other witnesses.
