The Bombay High Court on Wednesday questioned the maintainability of a suit with respect to a property dispute filed by singer Adnan Samis wife.
Adnans wife Sabah Adnan Sami Khan had moved the court seeking a restraining order against the singer to prevent him from entering the flats gifted to her by the singer. According to her petition before the High Court the Pakistani singer had gifted her five flats at Oberoi Sky Garden in suburban Andheri after they got married in April 2007.
The petition claims that the two other flats in the same building were mortgaged to her by Adnan.
Sabah contended that their marriage is in trouble and a divorce is in the offing for which she has moved the family court.
Justice A V Nirgude,however,questioned the maintainability of the suit and observed that the couple should pursue it before the family court. Sabahs counsel SU Kamdar however contended that the High Court has the jurisdiction to hear the suit.
He also submitted that both the parties are not Indian citizens. While Adnan is a Pakistani,Sabah is a citizen of UAE.
He further stated that though Adnan had gifted the flats in question to her but thereafter lot of problems arose between the two that led to a spat between the couple.
Kamdar sought an interim injunction to restrain Adnan from entering the flats. Sabah contended that Adnan can stay in the other flats which he owns.
Justice Nirgude observed that there should be some forum available to them as both parties are residing in India. Sabah also stated that Adnans ailing father is also staying in her flat to which she has objections.
Her case is that Adnan has been mistreating her because of which she has urged the court to restrain Adnan and his parents from entering the five flats which she claims her own. Speaking to reporters Adnan said that he just wants to be in peace with his father who is suffering from cancer of pancreas.
She even wants my dog Rock , Adnan said.
