HC notice to SP MLA for ‘acting against’ farmers

The lease deeds,according to the petitioners,were valid till March 31,2015.

The Allahabad High Court has issued notice to the Samajwadi Party MLA from Robertsganj,Avinash Kushwaha,directing him to explain his alleged intervention in getting cancelled the lease deeds for agricultural lands of many farmers around the Dhandraul dam in Sonbhadra district.

The lease deeds,according to the petitioners,were valid till March 31,2015.

The court,meanwhile,has directed that the farmers be not dispossessed from their lands till further orders. The court passed the order on Thursday while hearing the petition of 24 farmers – Ram Bachan and others.

The Division Bench of Justice Sunil Ambwani and Justice Manoj Kumar Gupta,have given the petitioners one week time to file the rejoinder affidavit,after Kushwaha files his counter affidavit in three weeks’ time.

Mohammad Khalid,counsel for the petitioners,said,“The land leases under question had been issued to forefathers of petitioners by the Irrigation Department many years ago. The land had initially been acquired for construction of Dhandraul dam. The spare land left after the construction of the dam was given on lease to the farmers,who have been tilling the land for the past four decades.” But in November 2012,the Irrigation Department cancelled the lease deeds without giving the farmers any show cause notice under the influence of the MLA,alleged Khalid.
