HC dismisses plea challenging continuance of IIIT-A director

The Allahabad High Court has dismissed the petition of an assistance associate professor of the Indian Institute of Information Technology-Allahabad (IIIT-A) challenging the continuance of Dr MD Tiwari as Director of the institute. Tiwari has been the director of the institute since 2002.

The petitioner had argued that his tenure had come to an end in January 2012,and he should have vacated the office. Passing the order on Wednesday,a division bench of Justices Ashok Bhushan and Abhinava Upadhyaya said: “We are of the view that the appointment of respondent No. 5 (Tiwari) on the post of director of the institute was not contrary to the rules and his continuance in the office is supported by rule 13.1 of the rules of the institute (pertaining to the appointment of director) which are still in force…The writ petition is dismissed.” The petition was filed by Dr Tapobrata Lahiri,who was in the bio-informatics department,on July 13,2012,a few days after disciplinary proceedings were initiated against him when he allegedly misbehaved with the director,while appearing before the Performance Appraisal Committee. He is currently under suspension.
