Having lost confidence in the CID probe into the killing of Tapan Dutta,a Trinamool Congress leader and an environmental activist at Baly, his wife Protima Dutta has approached the Calcutta High Court for a CBI investigation.

The probe into the case was handed over to the CID,which filed a chargesheet against five persons, who were arrested and released on bail.

In a writ petition filed in the Calcutta High Court,Protima Dutta has alleged that the CID did not carry out the probe in a fair manner. The charge-sheet filed by the CID exempted people of the ruling TMC party, including a minister, whose role was suspect in the killing, claims Protima, who, incidentally,is also a TMC supporter.

Tapan Dutta was killed on May 6 last year when some miscreants opened fire on him near Bally railway station while he was driving a motorbike with his friend. He had organised a movement at Bally area against some housing companies for filling up water bodies and ponds. He had also filed a writ petition in the High Court in this regard, and the case is still pending there.

On August 30,the CID filed a charge-sheet against five accused persons, namely Ramesh Mahato,Sasti Gayen,Asit Gayen,Subhas Bhowmik and Kartik Das,who allegedly owed allegiance to the TMC. The CID had filed a supplementary charge-sheet on September 26 .

In the petition,Protima Dutta claims that the CID;s original charge-sheet had mentioned the names of some Trinamool Congress leaders as well as that of a minister. The CID,however, omitted the names in the supplementary chargesheet.

In the original chargesheet filed by the CID,Protima Dutta said,it was stated: “There was a long standing enmity among the deceased and some of the TMC leaders of the area over the issue of ash filling of Suti canal and Haral canal and other two canals for Anmol South City Project – a joint collaboration (real estate project) with WB Govt. The deceased formed an organisation named Jalabhumi Bachao Committee to prevent the filling up ponds. The other TMC leaders of the area including a minister in Mamata Banerjee cabinet tried to influence the deceased by money and other means but failed. Then opponents formed a syndicate.”

In the supplementary charge-sheet filed on 26-9-2011,the CID “stated that there is no evidence against some crucial persons including the minister’’.

According to the petition,Protima Dutta wrote a letter to Chief Minister Mamata Banerjee on January 18,2012 for handing over the case to CBI for fair investigation but to no avail.
