The CID on Monday submitted the chargesheet into the robbery at a convent school in Ranaghat and rape of a 71-year-old nun in March but did not name the main accused, who is allegedly the rapist.

While the incident had taken place on March 13, the CID submitted the chargesheet on the 86th day after being handed the case. The report was submitted to the GRO office of Additional Chief Judicial Magistrate Bishnu Baran Mondal of the Ranaghat court. Bijay Kumar Yadav, the CID investigation officer, submitted the chargesheet against the five accused — Salim Sheikh, Gopal Sarkar, Khaleda Rahaman Mintoo, Milan Sarkar and Ohidul Seikh. All have been arrested.

Nazrul Islam alias Noju — the main accused in the case — who was arrested from Sealdah railway station in Kolkata a few days ago, was not named in the chargesheet. While Salim was arrested from Mumbai, Gopal was held from Habra, Mintoo from Bongaon and Milan and Ohidul from Sealdah.

Asked why Noju, who reportedly raped the nun, was not named in the chargesheet, SSP (CID) Chirantan Nag said: “We don’t have the lab test reports yet and in the absence of such evidence, we cannot name him.”

“This is the first chargesheet. While five of the six arrested have been named in it, Noju has been mentioned as the latest one to be arrested, who is being interrogated. They have been accused of dacoity, rape, criminal conspiracy and harbouring criminals,” he added.
Maintaining that the chargesheet was voluminous, Nag said: “We have mentioned that there were some other people, who were involved in the crime, are absconding. As and when they they are arrested, supplementary chargesheets will be filed.”

The five have been charged under IPC sections 120B (punishment for criminal conspiracy), 395 (punishment for dacoity), 397 (robbery or dacoity with attempt to cause death or grievous hurt), 376 (sexual assault), 376 D (intercourse), 212 (harbouring offender), 216 A (penalty for harbouring robbers or dacoits) and 109 (punishment of abetment).

Later, IGP-II (CID) Vineet Kumar Goyal told mediapersons in Kolkata that investigations were underway on the role of Noju, the main accused in the case. “We are collecting more evidence against him. His name will come up in a supplementary chargesheet,” he said.

Describing the incident as related to “property-crime,” Goyal said: “Gopal has been accused of harbouring criminals to commit the crime… It was a pre-planned crime with the intention of robbery. The rape happened after there was resistance. One of the gang members was a pervert… But the liability of the rape lies upon everybody.”

Fingerprints gathered from the place of crime have matched with three persons named in the chargesheet. All the five named in the chargesheet have admitted to their role in the crime and witnesses at the convent school in Ranaghat also have identified them during a test identification parade, police said, adding that 70 witnesses had been interrogated by CID in its probe.

Goyal, however, ruled out any role in the crime by the security guard of the convent school. The gang, the CID IG said, has been involved in various robbery cases in the state, including a healthcare centre at Balurghat, a failed attempt of robbing one electricity billing centre in Kharagpur and one in Malda.

“All the accused are Bangladeshis nationals and have been involved in various crimes in the state of looting schools and homes,” he said.

Between 1 am and 4 am on March 14, eight persons had entered the school campus, overpowered the security guard, broke open the safe and stolen around Rs 12 lakh. They had then gone to the first floor and raped the nun in her room.
