Drunk rapist gets away with milder sentence

A city court has sentenced a man convicted of gangrape to 10 years in prison.

A city court has sentenced a man convicted of gangrape to 10 years in prison,the minimum sentence for the crime,on the ground that since he was heavily drunk when he committed the crime and there was “every possibility for his reformation”.

The sentence was delivered by a fast track court in Dwarka,set up earlier this year for speedy disposal of cases related to sexual crimes against women. The court handed the man the least term for the offence on the ground that he committed the crime in “a state of drunkenness”.

The woman was allegedly gangraped by three of her husband’s friends. Her husband allegedly took Rs 2,500 from them to let them rape her. Two of them are being tried by the Juvenile Justice Board. The third accused was convicted.

Additional Sessions Judge Virender Bhatt said in his order,“No doubt the offence committed by the convict is intensely grave,barbaric and brutal in nature,still I find that his being drunk at that time is a mitigating factor in his favour,which persuades me not to inflict any sentence of imprisonment… which is greater than the minimum prescribed for the offence of gangrape.”
