Arvind Kejriwal’s secretary in line of MHA fire

Action against Rajender Kumar on cards if he doesn’t vacate home secretary’s post.

The Union Home Ministry is all set to initiate disciplinary action against senior IAS officer Rajender Kumar, who continues to hold the post of home secretary in the Delhi government despite the Centre’s instruction to relinquish it. MHA will issue a “show-cause” notice to Kumar under the provisions mentioned in the All India Service Rules for disobeying the orders of the cadre-controlling authority — MHA being the one in this case.

The action against Kumar, who is also secretary to Chief Minister Arvind Kejriwal, will be initiated for disobeying the Home Ministry order and his failure to relieve the post of Delhi’s home secretary, which he took over following a Delhi government order, official sources said.

Kumar assumed the charge of home secretary after the city government shifted incumbent senior IAS officer Dharam Pal and placed him at the disposal of the Home Ministry following a tussle between the AAP government and Lt-Governor Najeeb Jung over the appointment of Mukesh Kumar Meena as chief of Anti-Corruption Branch.

Following this turn of events, the L-G reinstated Dharam Pal. The chief secretary too wrote to Kumar that following MHA instruction, the Delhi government order appointing Kumar as home secretary is rescinded.

The home ministry has revoked the decision of Delhi government to repatriate its principal secretary (home, land and buildings) Dharam Pal to the Centre, terming it “ab initio void” and asserted that powers to transfer AGMUT cadre officers rest only with the Centre. The Ministry has also cancelled the appointment of Ashwani Kumar, an AGMUT cadre IAS of 1992 batch, as the new secretary (land and buildings).

Officials said the alleged corruption case against Kumar need not require a sanction from the cadre-controlling authority and in all likelihood, ACB will investigate the case.
