Pawan says Mukesh owed him money,testified against him to settle scores

Delhi gangrape case drew to a close on Tuesday with accused Pawan joining the rest in claiming that he was innocent and not present at the scene of the crime.

In a parallel to the testimony given by co-accused Vinay on Monday,Pawan,a fruit vendor,told Additional Sessions Judge Yogesh Khanna that he was at a musical programme with Vinay and Vinay’s mother,sister and neighbour at the time of the incident.

Earlier,co-accused Mukesh had testified that Pawan along with the other four accused in the case — Ram Singh,Akshay,Vinay and a minor — were present at the back of the bus where the rape allegedly took place.

Pawan claimed that Mukesh had testified against him to settle past scores.

“He used to purchase fruits from me on credit and never paid on time. We had a fight on this issue,” Pawan said.

Pawan also told the court that the male friend accompanying the victim on the night of the incident was unable to identify him initially.

“He identified me at the instance of police. Police were only interested in completing the number of the accused and asked him to identify me since I lived in Ravi Dass Camp,” Pawan said.

According to the prosecution,the bus aboard which the rape took place was found parked at Ravi Dass Camp. Accused Ram Singh,Vinay and Pawan were staying in the camp.

When questioned about the mobile phone recovered from him,he said he was heavily drunk on the night of December 16 and had lost his phone that night.

He echoed the earlier statements given by other accused in that he was beaten by the police,made to confess by signing

on blank sheets of paper and that the evidence against him was fabricated.

The 23-year-old paramedic student,gangraped in the moving bus on December 16,2012,died in a Singapore hospital 13 days later. One of the six accused in the case,the driver of the bus,Ram Singh was found dead in his cell in Tihar jail on March 11.

A minor accused is being tried by the Juvenile Justice Board and the verdict in his case is likely to be out on July 25. A fast track court at Saket is conducting the trial of the four accused on a daily basis.

All the four accused have claimed that they were innocent and not present at the scene of the crime.

While Mukesh claimed that he was driving the bus when the rape occurred,Akshay claimed that he was at home on the night of the incident.

The defence counsel representing accused Akshay and Vinay shall be producing a list of witnesses to present their case to the court on Wednesday.
