The court of Additional District and Sessions Judge Najar Singh on Wednesday framed charges against the two accused in the rape-on-wheels case. The accused – M K Jain,a business man from the city and Manoj Pal – have been charged with appropriate sections of the IPC.
The victim had alleged that she was drugged and abducted by both the accused from Amartex Chowk,Industrial Area on February 8,2003.
Terminder Singh,advocate of the accused said,The report of DSP Panchkula has highlighted the fact that the same woman has previously accused M K Jain of rape,which was proved to be false,Therefore,her statement can not be trusted. In this context,the charges against M K Jain has been framed in doubtful circumstances.
The Chandigarh Police had registered a case in August 2002 against former UT home secretary N K Jain and four others for hatching a conspiracy to frame Jain in the rape case.
The Shimla-based girl had alleged that Jain had picked her up from a Sector 20 computer centre,saying he would give her a job. On their way to Panchkula,she alleged,Jain gave her a drink laced with drugs and later raped her,before dumping her near the Sector 33 petrol pump.
However,after investigations conducted by the UT police,it came to light that the victim had not been raped by Jain,but by the former UT home secretary,who hatched a conspiracy to falsely implicate the businessman. On August 7,2010,the court framed charges against N K Jain,Ram Lal,Surinder Sharma,Baldev Kumar and Narvir Singh.
Then,on February 8,2003,the victim again alleged that accused had raped her.
