Four years after a lower court awarded life imprisonment to five accused of raping a German tourist,the Punjab and Haryana High Court on Monday upheld verdict.
The High Court on Monday dismissed an appeal challenging their sentence. Refusing to interfere with the lower courts decision,the High Court Monday upheld the life imprisonment given to them.
On January 28,2009,in a quick disposal of a rape case,a local Chandigarh court had given a life sentence to five of raping a 20-year-old German tourist in September 2008. Pankaj Punia,Manvir Singh Jolly,Harpreet Singh Dalli,Sukhwinder Singh Sukhi and Sompal were booked for kidnapping the woman from outside a five star hotel in Chandigarh on September 28,2008 and taking her to a farmhouse in Haryanas Samalakha area where she was gangraped.
The five youths were convicted under Section 376 (2) (g) of the Indian Penal Code and were awarded life imprisonment.The court had also slapped a penalty of Rs 20,000 on each one of them. The court awarded three-year jail term for their conviction under section 473 and five-year for the offence under section 363/366 besides imposing a fine of Rs 3,000 for each of these two offences.
The court had also awarded a one-year jail term and a fine of Rs 1,000 under Section 506. The total fine payable by each convict would be Rs 27,000 and all the four prison terms will run concurrently.
The in-camera proceedings of the case were held on January 16-17. The recording of statement and cross-examination of the German girl was completed on January 17,2009. The victim spoke in German during recording of her statement and was helped by three interpreters,one from the German Embassy.
