HC issues notices to CBI over photocopies

The Punjab and Haryana High Court on Wednesday issued notice to the CBI while acting on a petition filed by Justice (retd) Nirmal Yadav,accused in the judge bribery case,seeking photocopies of the record of the Union Ministry of Law and Justice pertaining to her prosecution sanction.

The Punjab and Haryana High Court on Wednesday issued notice to the CBI while acting on a petition filed by Justice (retd) Nirmal Yadav,accused in the judge bribery case,seeking photocopies of the record of the Union Ministry of Law and Justice pertaining to her prosecution sanction.

Earlier,Justice Sabina,had,on February 21,ordered to list the case before some other bench. Yadav had sought directions to authorities to furnish the photocopies of the record at her own cost.

Justice Yadav had approached the High Court after her plea was rejected by the Special CBI court,Chandigarh on February 2.

It was argued that if the record was lying with the court there was no harm in giving it to Yadav. Counsel for Yadav had argued that,with record in hand,the lawyer can assist the Court in a better way.

During the hearing of the case in the special CBI court,CBI special public prosecutor Anupam Gupta had opposed the demand of documents on the grounds that it was not permissible under the Criminal Procedure Code (CrPc).
