Fresh summons issued to Badals

A local court has issued fresh summons to the Punjab Chief Minister and other persons in an ongoing suit for damages to the tune of Rs 2.1 crore for malicious prosecution,filed by a former Additional Director,Information and Public Relations,Punjab,Jagdip Singh Chowhan.

A local court has issued fresh summons to the Punjab Chief Minister and other persons in an ongoing suit for damages to the tune of Rs 2.1 crore for malicious prosecution,filed by a former Additional Director,Information and Public Relations,Punjab,Jagdip Singh Chowhan.

The fresh summons in the case have been issued after the summons issued on March 14 could not be served. The court had summoned Punjab CM Parkash Singh Badal,Bureaucrats R S Mann,Sarvesh Kaushal,Paramjeet Singh Aujla,Mandip Singh Sandhu and Mohinder Singh Kainth,Mukand Singh Sandhu,SK Verma and seven others on June 11.

Chowhan had restarted a suit for damages filed by him on August 6,2003 against the Punjab CM and other bureaucrats of the state.

As per the case,Chowhan had filed a Rs 2.1 crore recovery suit for malicious prosecution against government of Punjab.

The top brass named in the case had lodged an FIR in the Police Station Vigilance Bureau at Mohali against JS Chowhan.

The case remained sine die for about a decade in a local court for leading evidence of prosecution by Chowhan,as per Chowhan.

The case dates back to the year 1998 when the government headed by Parkash Singh Badal decided to produce a film “The Khalsa” depicting the formation of Khalsa Panth by the Tenth Guru,Guru Gobind Singh during the tercentenary of the birth of Khalsa in April 1999.

JS Chowhan said that he was working as Additional Director and was looking after the Film Division Section of the Public Relations Department. He was falsely implicated under the Corruption Act as well as under Sections 420 and 120- B of the Indian Penal Code in the year 2000 by the Vigilance Bureau Punjab on the grounds that he had allegedly favored the producer of the film “Khalsa”,Mangal Dhillon and received pecuniary benefits from Mangal Dhillon and caused a loss to the state exchequer.

However,the court of District and Session Judge,Ropar acquitted Chowhan without framing charges on June 21,2002.

Chowhan then filed the defamation and damages suit against State of Punjab,Praksah Singh Badal and others which amounts to over Rs 2 crore.

This is the second recovery suit against Parkash Singh Badal by JS Chowhan at Chandigarh District Court. The other recovery suit is of Rs 82,032 is under trial for leading defence by the Badal duo.
