Estate firm fined for deficient service

UT District Consumer Redressal Forum has directed a city-based estates company to refund Rs 4 lakh along with a compensation and the litigation cost of Rs 20,000 to a complainant for not being able to provide the booked flat under the housing scheme.

Lt Col (retd) Inderjit Singh Cheema,a resident of Sector 47,booked a flat in 2009 through the estate company,Ansal Lotus Melange,under the project known as Palm Grove in Sector 115,Mohali. Inderjit stated that he deposited the entire amount demanded by the opposite party on a condition that the said plot will be given within a period of 24 months.

But the opposite party failed to provide what it promised. After two years,when Inderjit served a legal notice to the company,he was offered another flat,away from habitation. Hence,he refused the same.

It was also averred that the opposite party charged the complainant an extra amount for increasing the area of the house by themselves,against the agreement which mentioned that no modifications will be done in the house.

Accusing the estate firm of unfair trade practice,the forum directed Ansal Group to refund the said amount to the complainant.
