Court lifts ban on framing charges against Doon MLA

The Punjab and Haryana High Court on Tuesday lifted the stay on framing charges against Doon MLA Ram Kumar Chaudhary in the Hoshiarpur woman murder case.

The Punjab and Haryana High Court on Tuesday lifted the stay on framing charges against Doon MLA Ram Kumar Chaudhary in the Hoshiarpur woman murder case.

Taking serious note of accusations of manipulations allegedly done by the Haryana Police in the case under the influence of Chaudhary,the High Court on May 2 restrained a Panchkula lower court from framing charges till further orders.

The stay was lifted on Tuesday,as the High Court disposed of a petition filed by the 24-year-old deceased’s father,demanding an independent probe. Disposing of the petition,the High Court directed the trial court to consider both the reports submitted by

the Panchkula Police in

the case.

Initially,the police had submitted a final report. However,after the father had moved the High Court,accusing the police of deliberately leaving loopholes in the case with the intention to benefit the MLA,the police had constituted a special investigation team (SIT). The SIT,as demanded by the high court,in May,had submitted a status report. The high court has directed the Panchkula court to look into both the reports at the time of framing of charges.

Keeping in view the investigation done so far by the police,the high court on disposed of the petition.

The deceased’s father had launched a scathing attack at the Panchkula police for allegedly working under the influence of theCongress MLA. Counsel for the petitioner,Advocate N S Shekhawat,had alleged that key aspects were deliberately ignored by the

police,at the time of the

investigation.

However,to probe key aspects “left out” by the investigating officer,the SIT was constituted by the police on March 23.

The petitioner had also alleged that since Chaudhary belonged to the ruling party,the police were under tremendous pressure to “help” the MLA.

The counsel for the Haryana Police had countered the accusations,thus defending the investigations conducted by the police.

The woman was allegedly murdered by Chaudhary in Panchkula on November 22,2012. The postmortem report had confirmed that the woman had terminated her pregnancy,some months before her death.

Her cell phone records had revealed that she was in constant contact with the Doon MLA and his accomplices. Panchkula police had arrested six people,including the MLA,who were later chargesheeted.
