Not replacing a defective phone has cost a mobile company and its local retailer a penalty of Rs 10,000. Held deficient in services by the UT Consumer Disputes Redressal Forum,Karbonn Mobiles and SGS Mobile Junction has been further ordered to refund the price of the defective mobile set.

Anupama Goyal,a resident of Sector 41 had purchased a Karbonn A-11 cell phone for Rs 8,500 and was given one-year warranty on the same. However, within a month of purchase, the phone started giving her trouble by not showing any network signals. Aggrieved Anupama then gave the mobile set for repair to the company’s service centre.

It took the company 25 days to return the phone. Despite the repairs, the phone continued to show no signal strength and did not function properly. When she approached the retail shop,SGS Mobile Junction, her mobile set was returned unrepaired. Finally,Goyal wanted the mobile set replaced as it suffered from manufacturing defects. But her requests were not paid any heed to by the opposite parties forcing Goyal to file a consumer complaint.

In an exparte order, the forum ruled Goyal’s contentions as correct as they went unrebutted. The forum directed the compnay to pay the refund amount of Rs 8,500 and compensation within a month.
