The Panchkula police has registered an FIR against a resident of Agra for allegedly uploading a picture of an FIR report on Facebook. The Facebook picture allegedly listed his sister-in-law,a resident of Panchkula, and her family in the FIR report due to which the woman’s father approached the police.

Gaurav Sehgal, the accused, has been booked for charges of insulting a woman under section 509 of the Indian Penal Code and for sending offensive information, breach of privacy, and misrepresentation under sections 66A,71,72 and 72A of the Information Technology Act.

According to the complainant’s daughter, she noticed the uploaded image on August 5,after which she asked her father to file a complaint. The accused removed the picture after a few days, she said.

Mukesh Kumar,Station House Officer of Sector 5 Police Station, said,“Sehgal has put up the image for the sole purpose of defaming and insulting the complainant because the said FIR has already been recommended for cancellation by the police

authorities concerned, and will soon be quashed by

the court.”

According to public prosecutor Atul Sethi, it is not illegal per se to upload an FIR report on the internet, but once the final report by the police is filed, and the inquiry is complete, then such an action may come under the purview of the IT Act as it is usually done to defame someone.
