Even as the Gujarat High Court Judge,Anant S Dave,on Thursday refused to hear applications challenging the anticipatory bails given to state minister Maya Kodnani and former VHP general secretary Jaydeep Patel,two riot victims moved the court seeking they be made a party to the case.

In separate applications,Dilavar Umrav Saiyed,a resident of Naroda Patiya and Imtiyaz Ahmed Hussain Qureshi from Naroda Gam,said they intended to submit details regarding involvement of Kodnani and Patel in the two riot cases and hence they be include as a party in the cases.

In his submission,Saiyed said that he had seen Kodnani

handing over sticks and swords to some persons in the Naroda Patiya area around 11.15 am on February 28,2002.

This was done in the presence of Naroda police inspector K K Mysorewala.

Thereafter,he said,a mob of over 1,000 people gathered and after provoking them,Kodnani drove towards Naroda Gam in her white Maruti car.

Qureshi,in his application,submitted that he had seen Patel giving some instructions to a mob near the Muslim Mohalla in Naroda Gam. The mob,thereafter,he said,burnt down a dargah and Hotel Mayur.

Both the applicants were represented by advocate S H Iyer,a representative of Jan Sangharsh Manch.

Iyer said that one more victim Nannumiyan Rasulmiyan Malek,who lived in the Muslim Mohalla of Naroda Gam during the riots,will also file an application appealing to the court to make him a party to the case pertaining to the cancellation of

anticipatory bail to Kodnani and Patel.
